These Terms of Service (“Terms”) govern your access to and use of the HotelBarDost POS software (“HotelBarDost”, the “Software”) and the website hotelbardost.com (the “Website”), provided by Mentark Tech Private Limited(“Mentark Tech”, “we”, “us”).
By purchasing, installing, or using HotelBarDost, you agree to these Terms. If you do not agree, do not purchase or use the Software.
“Software” means the HotelBarDost Windows desktop POS application.
“License” means the limited right to use the Software granted under these Terms.
“Annual Support” means the optional yearly support and maintenance service.
“Customer” means the person or business that purchases a License.
You must be legally able to enter into a binding contract under Indian law and must be authorized to act for the business purchasing the License. HotelBarDost is a business product and is not intended for personal or consumer use.
Subject to these Terms and payment of the one-time purchase price, Mentark Tech grants you a perpetual, non-exclusive, non-transferable, machine-bound license to use the purchased version of the Software on one computer/terminal per outlet. Additional terminals or outlets require separate licenses.
This is a license, not a sale. You do not acquire ownership of the Software, its source code, user interface, trademarks, branding, database schema, or other intellectual property, all of which remain owned or licensed by Mentark Tech Private Limited.
The current purchase price is ₹17,000 (one-time) for a perpetual license to the purchased version of the Software. Applicable taxes, if any, are extra as required by law.
Refund and cancellation terms are not separately published at this time. If you have a refund or cancellation query, contact us at 8421470722 or hotelbardost@gmail.com before purchase for clarification.

Annual Support is available at ₹3,000 per year and covers ongoing technical support and applicable maintenance/services. Annual Support is optional and is not a mandatory subscription. Purchasing the License does not require purchasing Annual Support. There is no mandatory monthly subscription.
What happens if Annual Support is not renewed
The Software is activated on a specific computer using a Machine ID and an activation key provided by us. The License is machine-bound — one activation per PC. To move the License to new hardware, contact support.
You may use the Software for your lawful hospitality business operations on the licensed computer in accordance with these Terms.
You may not:
You are responsible for maintaining your computer, operating system, and compatible hardware; for entering accurate data; for securing your device and access credentials; and for complying with all laws applicable to your business.
You retain ownership of your business data — including sales, inventory, bills, reports, customer Khata records, and other business records you create. Mentark Tech does not claim ownership of your business data.
The Software, source code, UI, trademarks, branding, and database/schema design remain the property of Mentark Tech Private Limited as applicable.
HotelBarDost provides automatic local backup and recovery functionality. However, no software can guarantee recovery from every hardware failure, disk failure, malware incident, accidental deletion, operating-system failure, or catastrophic event. You should periodically verify that backups are available and maintain your own additional backups where appropriate. We do not promise that data can never be lost.
Your License is perpetual for the purchased version. Future upgrades or feature releases may be offered separately and are not guaranteed as part of the one-time purchase unless separately communicated in writing. HotelBarDost does not provide automatic online updates.
HotelBarDost supports compatible Windows PCs and configured thermal printers. Hardware performance, Windows configuration, printer drivers, network/Wi-Fi hardware, and third-party devices may affect operation. We do not guarantee compatibility with every printer or Windows computer.
HotelBarDost provides configurable billing and tax functionality. It does not guarantee tax compliance. You remain responsible for correct tax configuration, applicable rates, invoices, filings, accounting, and obtaining professional tax advice.
HotelBarDost can generate FLR 1/A and FLR-4 style excise reports and PDF exports based on the business data you configure. HotelBarDost is not government-certified, government-approved, legally guaranteed, or officially endorsed.
You remain responsible for maintaining the correct license, entering accurate data, complying with applicable state excise requirements, verifying current formats/requirements with the relevant authority, and submitting records where required. The Software assists with record generation; it does not replace your legal or compliance responsibility.
All intellectual property in the Software, including source code, UI, trademarks, branding, and database/schema design, is owned or licensed by Mentark Tech Private Limited. These Terms do not transfer any such ownership to you.
Each party will keep the other's confidential information confidential, except where disclosure is required by law.
Support is available by phone/WhatsApp at 8421470722 and by email at hotelbardost@gmail.com. Support hours are 9 AM – 10 PM. We do not provide 24/7 support.
Support generally covers troubleshooting, installation assistance, software-related issues, database recovery assistance where technically possible, printer/software configuration assistance, and reasonable product support.
HotelBarDost is an offline desktop product and does not depend on our servers for day-to-day operation. We are not liable for interruptions caused by your hardware, operating system, network, power, or third-party devices.
The Software is provided “as is” without warranties of any kind, express or implied, to the extent permitted by law. We do not warrant that the Software will be error-free, uninterrupted, or compatible with all hardware, or that it will meet any specific legal, tax, or excise compliance requirement.
To the maximum extent permitted by law, Mentark Tech's total liability arising out of or relating to these Terms or the Software shall not exceed the amount you paid for the License. We are not liable for indirect, incidental, special, consequential, or lost-profit damages, or for loss of data.

You agree to indemnify and hold Mentark Tech harmless from claims arising from your misuse of the Software, your inaccurate data, or your violation of applicable laws, to the extent permitted by law.

We may suspend or terminate access for material breach of these Terms, unauthorized use, or non-payment where applicable.
Upon termination for breach, your License ends and you must stop using the Software. Your business data remains yours; you are responsible for exporting or retaining it before termination where applicable.
We may update these Terms from time to time. The updated version will be posted on the Website with a revised “Last Updated” date.
These Terms are governed by the laws of India.
